Welcome to Touch The Peak, a job platform operated by the Career Skills Development Society (CSDS) in collaboration with the Career Guidance Unit of the University of Sri Jayewardenepura. By accessing or using our platform, you agree to be bound by these Terms & Conditions.

1. Definitions

  • "Platform" refers to the Touch The Peak website and all related services.
  • "Student" refers to any undergraduate currently enrolled at the University of Sri Jayewardenepura who registers on the Platform.
  • "Company" refers to any organization or business entity that registers on the Platform to post job opportunities.
  • "User" refers to both Students and Companies collectively.
  • "Services" refers to job posting, job applications, profile management, and all other features provided by the Platform.
  • "CSDS" refers to the Career Skills Development Society of the University of Sri Jayewardenepura.
  • "CGU" refers to the Career Guidance Unit of the University of Sri Jayewardenepura.

2. Eligibility

2.1 For Students

  • You must be a currently enrolled undergraduate at the University of Sri Jayewardenepura.
  • You must register using your official university email address (ending in .sjp.ac.lk).
  • You must provide accurate and truthful information in your profile.
  • You must be at least 18 years of age.

2.2 For Companies

  • You must be a legally registered business entity in Sri Lanka or have operations in Sri Lanka.
  • You must provide accurate company information and valid contact details.
  • You must use a legitimate company email address (not personal email services).
  • Your company account is subject to approval by Platform administrators.

3. Account Registration and Security

3.1 Account Creation

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You must provide accurate, current, and complete information during registration.
  • You must update your information promptly if it changes.

3.2 Account Security

  • You are solely responsible for all activities that occur under your account.
  • You must notify us immediately of any unauthorized use of your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

4.1 General Conduct

You agree NOT to:

  • Use the Platform for any illegal or unauthorized purpose.
  • Impersonate any person or entity.
  • Submit false, misleading, or fraudulent information.
  • Harass, abuse, or harm other users.
  • Attempt to gain unauthorized access to the Platform or its systems.
  • Use automated systems (bots, scrapers) to access the Platform without permission.
  • Interfere with the proper functioning of the Platform.

4.2 For Students

You agree to:

  • Apply only for positions you are genuinely interested in.
  • Respond professionally to communications from Companies.
  • Attend scheduled interviews unless you notify the Company in advance.
  • Provide accurate information in your applications.

4.3 For Companies

You agree to:

  • Post only legitimate job opportunities.
  • Respond to student applications in a timely and professional manner.
  • Not discriminate against applicants based on race, religion, gender, disability, or any other protected characteristic.
  • Comply with all applicable employment laws and regulations.
  • Not request sensitive personal information beyond what is necessary for hiring.

5. CV and Personal Data Usage (For Companies)

5.1 Data Use Restrictions

Companies accessing student CVs and personal information through the Platform agree that:

  • All CVs and student information will be used solely for reviewing candidates and making hiring decisions for the Company.
  • CVs and student data will NOT be shared, distributed, or forwarded to third parties, other companies, or external recruitment agencies.
  • Student data will be handled in accordance with applicable data protection laws.
  • Data will be retained only for as long as necessary for the recruitment process.

5.2 Violations

Any misuse of student data may result in:

  • Immediate termination of the Company's access to the Platform.
  • Permanent ban from the Platform.
  • Legal action as permitted by applicable laws.
  • Reporting to relevant authorities.

6. Job Postings

6.1 Posting Guidelines

Companies must ensure that all job postings:

  • Are accurate and describe actual available positions.
  • Include clear job descriptions, requirements, and compensation details (where applicable).
  • Do not contain discriminatory language or requirements.
  • Comply with Sri Lankan labor laws and regulations.
  • Do not promote illegal activities.

6.2 Prohibited Postings

The following types of postings are prohibited:

  • Multi-level marketing (MLM) or pyramid schemes.
  • Positions requiring payment from applicants.
  • Fraudulent or non-existent job opportunities.
  • Positions promoting illegal activities.
  • Adult content or inappropriate material.

6.3 Review and Removal

CSDS reserves the right to review, modify, or remove any job posting that violates these Terms without prior notice.

7. Applications

7.1 Application Process

  • Students may apply for positions through the Platform.
  • Companies are responsible for managing their application review process.
  • The Platform does not guarantee employment or interview opportunities.

7.2 Communication

  • All initial communication should occur through the Platform.
  • Both parties may exchange contact information for further communication as needed.
  • Users must maintain professional conduct in all communications.

8. Intellectual Property

8.1 Platform Content

  • The Platform, including its design, logos, text, graphics, and software, is the property of CSDS and the University of Sri Jayewardenepura.
  • You may not copy, modify, distribute, or create derivative works without explicit permission.

8.2 User Content

  • You retain ownership of content you submit (CVs, job postings, profiles).
  • By submitting content, you grant CSDS a non-exclusive license to display and use that content for Platform operations.

9. Privacy

Your use of the Platform is also governed by our . By using the Platform, you consent to the collection and use of your information as described in the Privacy Policy.

10. Disclaimers

10.1 No Guarantees

  • CSDS does not guarantee employment or hiring outcomes.
  • CSDS does not verify the accuracy of all information provided by Users.
  • CSDS is not responsible for the conduct of Users outside the Platform.

10.2 Third-Party Content

  • CSDS is not responsible for the content of job postings or applicant profiles.
  • CSDS does not endorse any Company or Student on the Platform.

10.3 Availability

  • The Platform is provided "as is" without warranties of any kind.
  • CSDS does not guarantee uninterrupted or error-free access to the Platform.

11. Limitation of Liability

To the maximum extent permitted by law:

  • CSDS shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
  • CSDS's total liability shall not exceed the amount paid by you (if any) for using the Platform.
  • CSDS is not liable for any actions taken by Companies or Students outside the Platform.

12. Indemnification

You agree to indemnify and hold harmless CSDS, the University of Sri Jayewardenepura, and their officers, directors, employees, and agents from any claims, damages, or expenses arising from:

  • Your use of the Platform.
  • Your violation of these Terms.
  • Your violation of any third-party rights.

13. Termination

13.1 By You

You may terminate your account at any time by contacting us.

13.2 By CSDS

We may suspend or terminate your account if:

  • You violate these Terms.
  • We believe your actions may harm other Users or the Platform.
  • Required by law.

13.3 Effect of Termination

Upon termination:

  • Your access to the Platform will be revoked.
  • Your profile information may be deleted.
  • Certain provisions of these Terms will survive termination.

14. Changes to Terms

  • We may update these Terms from time to time.
  • We will notify Users of significant changes via email or Platform notifications.
  • Continued use of the Platform after changes constitutes acceptance of the new Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Democratic Socialist Republic of Sri Lanka. Any disputes shall be subject to the exclusive jurisdiction of the courts of Sri Lanka.
